Hawaii Could Be First to Put Gun Owners in Federal Database

Hawaii could become the first state in the United States to enter gun owners into an FBI database that will automatically notify police if an island resident is arrested anywhere else in the country.

Most people entered in the "Rap Back" database elsewhere in the U.S. are those in "positions of trust," such as school teachers and bus drivers, said Stephen Fischer of the FBI's Criminal Justice Information Services Division. Hawaii could be the first state to add gun owners.

"I don't like the idea of us being entered into a database. It basically tells us that they know where the guns are, they can go grab them," said Jerry Ilo, a firearm and hunting instructor for the state. "We get the feeling that Big Brother is watching us."

Supporters say the law would make Hawaii a leader in safe gun laws. Allison Anderman, a staff attorney at the Law Center to Prevent Gun Violence, said the bill was "groundbreaking," and that she hadn't heard of other states introducing similar measures.

Sen. Will Espero, who introduced the bill, and the Honolulu Police Department said Hawaii could serve as a model for other states if it becomes the first to enact the law.

 

Yet others say gun owners shouldn't have to be entered in a database to practice a constitutional right.

"You're curtailing that right by requiring that a name be entered into a database without doing anything wrong," said Kenneth Lawson, faculty at the University of Hawaii's William S. Richardson School of Law.

Legal experts say the bill could face challenges, but would probably hold up in court. Recent Supreme Court rulings have clarified states' ability to regulate gun sales, said David Levine, a law professor at the University of California, Hastings College of the Law.

The bill will undergo a legal review process by departments including the Attorney General's Office, which supported the bill, before Gov. David Ige decides if he will sign it into law, said Cindy McMillan, a spokeswoman for the governor.

The cost to enter names in the database will be covered by a fee paid by gun owners, which wasn't defined in the bill.

Even though other states don't enter gun owners in the database, Honolulu Police Department Maj. Richard Robinson said it will still benefit Hawaii police. Right now, Hawaii gun owners undergo a background check only when they register a gun, so police have no way of knowing if they're disqualified from owning a gun in the future unless they try to register a new firearm.

"We were only discovering things by accident," said Robinson, who helped draft the bill. "They happen to come register another firearm, we run another background check, and then we find out they're a prohibited person."

That happens about 20 times each year, he said.

Some local gun owners say the law confirms their fear that the government would know exactly who and where people keep their firearms.

"This is an extremely dangerous bill. Exercising a constitutional right is not inherently suspicious," said Amy Hunter for the National Rifle Association. "Hawaii will now be treating firearms as suspect and subject to constant monitoring."

It is my considered opinion that this is the watershed instance that will culminate in eventual total confiscation. Look at the other so called Free Nations that used to have free access to guns. Look long and hard at the gradual progression from registration to confiscation. It all follows a prescribed program, and we are in the middle of it in america simply because the Elites want to have total control over us, and give us nothing to oppose their dictates with.

and politely but firmly state your opposition to this act that will eventually make the Constitution meaningless.

At least the criminals will leave us gun owners alone. Just because a person is a criminal, does not mean they are stupid..I am fine with a state making their own laws about guns.If they want to be stupid about things. That is fine providing it does not effect me and my community...I would hope they do not allow it,but I have enough on my plate here were I live. Shrinking the federal government is what I want to see . I will not get involved in other States affairs other than supporting a candidate.

This is a test case that will affect all of us in every State of the union. It's just like when they used California as the test case for all the environment agendas in the 60's and 70's.

M, Hopefully , we are about to turn the corner on all this madness.But at any rate, What I said about the criminals directing their crime at those without guns to defend themselves will show this was a bad idea. To give criminals a log book of gun owners is insane....Plus do you really think gun owners will comply. The guy who has a 30-30 in his closet will not comply at all. The guy who does not hunt, but just has a riffle for protection ,will not comply.

It's not the criminals I worry about. It's the over reach and dictatorial proclivity of the Federal Government. this gun control has been going on since the early 1920's and is getting worse every year. The public thinks the Elitists will not get their way and we will keep our guns, even though at this point our guns are just the symbols of our freedoms.Overnight once the agenda to disarm American civilians has reached the tipping point, the powers that be will confiscate and impose drastic penalties on those who refuse to comply.

M, If you think we will roll over without an all out war, your crazy. Do you understand how many people have joined militias. Gun sales are through the roof. Community`s are getting together . Have you been aware of how many people are adjusting their life styles to accommodate what may be coming.  People are gardening, building chicken huts. Goats, beef cows...You name it. Smart people will be ready. Once Trump gets in, things will turn around. But there will be a movement of young anarchists who will need to be dealt with. Go talk to any cop. They can not wait to be able to do their job. The anarchy that the left has enabled will end. Providing the silent majority stays engaged , It will be fine for many voting cycles. As soon as the establishment thinking Progressives raise their heads again, They need to be dealt with. No more crony capitalism.

The key is Trump must win. If Hillary wins. The militias will move on any injustice done to the Constitution. Hillary and the left are in for a surprise if they think they can maintain the crimes they have done.

I am not going to get into the morality of the situation, nor am I going to disparage the fact that there are a lot of veterans who would fare well in such a situation. But the fact is an untrained and undisciplined civilian force is just a mob, and mobs are easily routed and/or destroyed. Anyone who believes otherwise has seen too many movies that portray a false set of conditions which could not happen in the real world.

If you watch the video, you can see the simpler types of weaponry that would be brought to bear against armed insurrectionists. Another thing to consider is how many Americans are combat hardened veterans? Anyone who has been in a combat situation knows it is the discipline that was instilled in basic training and further drilled in in AIT plus battle hardened Sergeants, that got a large percentage of those veterans through their first few encounters. Civilians do not have that kind of training. Finally, green troops are put in the field with trained and battle hardened troops NCO's and even sometimes seasoned Officers. How many civilians can expect that.

Seriously, there might be some scenarios that would predicate civilians acting as guerrillas and conducting operations if say the United States were to be invaded, but that would be with the help of the American Military, not in opposition to it. It is a fact of life that no revolution in history, including the American Revolution was ever won without outside help. We had France at the time and it was to the benefit of France to help us and take the British military pressure off of them.

All of that being said, the real way for us to revolt is through the power of the vote. The vote is the proper venue for citizens to use FORCE against a government that has basically ignored them, and their desired governance. Make no mistake, Voting is a use of force play, just like a military action is a force play, and it is usually stronger than any military action since it has the dual capability of destroying an insensitive corrupt government, and building a better one, all in the same movement. Military force only destroys things infrastructure and opposing military forces because that is it's job.

You do not get it. The militia is made up of many police officers now. Along with military...Who do you think will shoot fellow Americans. Certainly not police that understand and actually are on the same side of issues. Their paycheck at that point becomes a no factor. When the mass movement starts. You will be surprised how many will chose the right side according to their hearts.It will be a fight between the Soros anarchists and good militia members.The police will side with the militia ...That is simple logic....When the Soros group has another occupy movement, The militias will go occupy the same space and  take over and stop it. The police will be told to stand down by Hillary`s administration. But the militias will not take her orders....Now do you think the cops will come in and go against the militia who are doing the job they know in their hearts they want to do... You have some notion that it will go down unorganized. You think the militia are all a bunch of yahoos... Research will show you that I am right. You have retired generals counseling many militia leaders .Why do you think Stewart rhodes was upset that the Bundy gang moved when they did. The Budy gang ran on heart and a strong faith. LaVoy`s death does serve a purpose. It was a message to many. A wake up call. The Militia / Liberty movement is making big gains in the information battle. The shear numbers of patriots engaging is scaring the opposition . And I must add ,that Trump is fueling the liberty movement . He is teaching us to not cower to PC. He is giving us confidence.

It's you who fails to see what the outcome would be.

1. Obama removed the majority of "good" military officers that refused to fire on Americans and replaced them with ones who wouild.

2. the Ready Reserve that Obama has been building since his first days in office, the ones he wanted to be armed as good or better than the Military, and we can not get accurate reports on is another fasctor.

3. The questionable officers that pledged their alligence to Obama instead of the Constitution are the ones in control of all the UCAV weapons platforms.

4. I can't speak about the Classified weapons systems other than to say they make the UCAV's look like childs toys by comparison.

5. You are also selling short Military Command and Control for situations and the little known UN treaty that would allow Foreigh troops under UN command to invade our Country at Obama's or for that matter any sitting President's request to put down insurrections.

6. How would small arms be used to fight the Air Force and UCAV's flying above the effective range of the small arms?

7. Do you know how a Marine Force Recon or Seal team does what it does? I do. Think of how many of those teams could be activated to put down an armed insurrection. Civilians and even Police or National Guard could not stand against fully supplied, integrated and coordinated teams for very long.

It's nice to think we could do that, and we really could have up until the FDR Administration that started restricting what Civilians could own as far as armament is concerned. Until 1933 any American citizen could buy any Military item provided they had the money to do so. We can't do that now.

That leaves us with trying to use the non violent means first and foremost for change. It needs to be seriously tried first before going off half cocked
