Citizens Dedicated To Preserving Our Constitutional Republic

 This is something I would like to be passed around if you agree with it.
I recently read an article in Politico Magazine 
http://www.politico.com/magazine/story/2017/02/three-branches-gover... ) that should have shocked me but it did not. The premise of the article was the dissolution of the three branches of Government as the Constitution provided for, into just two or one. This is a condition that actually goes back to the end of the Civil War. Its roots are entangled with the abolition of Slavery and the unconstitutional restriction on States Rights hidden within the 14th amendment. You might ask how an amendment intending to secure the citizenship and voting rights of freed slaves could be construed to flip the intent of the Constitutional power flow. It did it with a stealth passage of three toxic words. Those three were worded so craftily that it begged to be misinterpreted and expanded on. The three toxic words were "No State Shall". Until that time, the Constitution gave supreme power to the people as the highest authority in government. The people exercised that power through the representatives they elected to their State Legislatures and to the representatives they elected to the Congressional House. That made the People through the State Legislatures and Congress in control over the Federal Government.
 In and by itself the 14th did not have the extensive power to change the power flow, it took the ratification of the 16th and 17th Amendments to allow the Federal Government to dictate to the States and the people instead of itself being told what it was going to do. The 16th amendment was speedily ratified because Congress wanted to create a constitutional direct tax in spite of the Constitutional caveat against one. Originally Congress enacted an income tax law but SCOTUS knocked it down as Unconstitutional. The 16th allowed the Government access to massive amounts of tax dollars so it could grow way beyond it's Founder intended size. The 17th Amendment essentially took the control of the Senators out from under their State Legislatures and with that the Senators need to actually represent their States over their political parties. Don't forget the Senate was created to give each State equal representation within the Congress and not to directly represent the people. That set of checks and balances no longer exists. We can see the lack of control the people have now because of that. Look how many laws have been pushed through the people have rejected to no avail.
With the three amendments working in concert to elevate the Establishment Federal Government, and consequently they have negated the 10th Amendment. The out of control government our Founders warned about is the present Government. No one man can reverse the actions that have built up over the last hundred or so years. It will take the majority of Americans working in concert to reestablish the principles our Founders created instead of the proto-Oligarchy that now exists in the Federal Government. Many of our fellow Americans have bought into the falsehood of massive central Government being good for the people. It simply is not true. Massive Central Government today is the neo Oligarchy. Oligarchies no matter what totalitarian form they take have one thing in common historically; Those Regimes always end up trying to abolish most of their own people, especially the deplorable hard headed people working for their Freedom. Oligarchies always find a way to give themselves the power to exterminate those who disagree with their agendas. It may not happen in the beginning, but it always manages to happen eventually.
The present Government faction that is most like the conditions is the Progressive Democratic Socialist Party we know as the Democratic Party. Over the last hundred years they have managed to move America towards a totalitarian state and away from the Republic we were created to be. They are going so far as to align themselves with other Totalitarian Regimes like the Islamists who also believe in world wide domination. It's the same story now as it was during this countries inception;m the Elites want to control everything and can't stand having stubborn people who they consider beneath them striving for Individual Freedoms, neither can they survive that and remain Elite. The current mess we are in revolves around the basic human condition of Laissez Faire/Laziness attitudes people fall into when they don't regularly participate in their own governance.  
Getting back on point, No longer do the schools and Colleges teach a line by line explanation of the Articles and Sections of our Constitution to educate students on what they are, and why they are included, as well as the interpretations they have gone through over time, so the students can make up their own minds about what is right and proper. The original meanings have been relegated to alternate facts by the controlling elites to fit in with their agendas. What was originally created was a unique set of separate powers delegated to the three branches of Government for them to act as checks and balances to each other. Since then the Elite class has been chipping away at the model and changing it little by little. With the Obama administration we have seen the culmination of that infiltration and change coming together to strip all power from the people and invest it in Central Government. Belatedly, the people recognized the threat to their way of life and elected an outsider to start rectifying the process. With the election of Trump, the American people have seen the extent of the infiltration and politicized propaganda that has been shoved down our childrens throats. Even though this is a digression from the main point, it is necessary to know this to see the actual effects of the three toxic amendments on our way of life.
In the beginning the Founders  refused to create a parliamentary form of government, and elected to create three generally equal branches of government governing the Republic. They threw in some democratic principles that were to be constrained by the written Constitution so America would not become a democracy. The Founders had decided to form a new way to govern, you could even call it the New World Order, where the people would govern themselves.
Today the Government has been deliberately mutated by agents of the Elites into a place where the imbalance in government destroys the peoples power to govern themselves. This is personified in the gradual increase beyond the Constitutional enumerated powers to it's epitome during the lawless Obama administration legislating through executive orders and bureaucratic regulations set to bolster an agenda for the Elites/Crony Capitalists. The Congress still neglects to exercise it's responsibilities seemingly because without term limits they are more concerned with getting reelected to their continuing positions in Congress rather than doing the jobs they were elected to do. Not all of them, but a substantial majority of them.  Since John Marshall decided to create an non-enumerated power of Judicial Review, SCOTUS has been regularly legislating from the bench and usurping the rightful power of Congress to be the sole creator of legislation. 
Presently We The People have a one time shot at actually having an Article V States controlled Amendment proposal convention to rectify all the extraneous powers that the Federal Government has created over and above what was delegated to it in the Constitution. We must at the very least Repeal or Modify the 14th Amendment and specify what it is allowed and Not Allowed to do. That means defining who is a natural born citizen and who is not (think stopping anchor babies). Returning all Election control to the States with provisions so they can't abuse the power. Like Defining who has protected voting rights and the best way to enforce accountability. Like a Nation wide Mandatory Picture ID and the elimination of same day voter registration. A defined process setting immutable guidelines for all the States elections commissions to follow. To end the unlimited access to taxpayer money the 16th needs to be repealed and with it reducing the IRS to a revenue agency that oversees Tariffs, and other apportioned taxes. 
The 17th needs to be repealed to return the Senators to the control of their State Legislatures with the original checks and balances on them for not faithfully executing the duties and demands of those legislatures.
I believe there should be a time limit on any proposed treaty for the Senate to ratify it or it simply ends. As it is now, any proposed treaty will keep going forever to be potentially ratified and that is what the Trans Pacific Treaty will do unless Trump cancels it officially. There are other worthy amendments that need to be created. Amendments concerned with Term Limits, Balanced Budgets W/penalties to Congress for not creating them in the time limit specified. Removal of the War Powers Act so Congress will be the decider of sending troops to wage war instead of the President alone for 60 days.Realistically do you think Congress will act to stop a military action after it has been started and Blood has been spilled? 
Remember Truman and Korea, Kennedy/Johnson and Vietnam? Congress did not use it's powers to stop those fiascos so another one providing for severe penalties to congress for shirking their duties over a declaration of war. We must get back to the idea that we will not send our troops to fight and die in foreign wars unless the people themselves have decided through their representatives it is necessary like WWII was necessary. A further clarification of the 2nd to show the citizens/people have a right to bear any arms the government has, and the 2nd was put in to allow the people the means to defend themselves against a government gone rogue like ours has, and removing every Federal Restriction/Law that exists to the contrary. in short, if we want to remain free and have access to our Liberties, we will have to engage with the government process.

The first is a comprehensive free online library that lists many constitutional points about an Article V convention with it's Pros and Cons, and the actual constitutional protections that prevent it from becoming a runaway convention as some naysayers like to create fear with. Neither is an Article V convention what has been called a Constitutional Convention by those same naysayers. The only difference between a Congress called Article V convention and a States petitioned for Article V convention is who is in control of what will be proposed. Congress has a poor record so far of only proposing amendments that will benefit them and the Federal Government in the long run. If the States petition for an Article V convention Congress MUST open it and stand back. The protections are basically the same. Delegates must agree on the wording of any proposed Amendment then send it to Congress. Congress must then send it out to the States for ratification by the people through the methods they have instructed their legislatures to use. It takes 34 States for a petition to congress for an Article V, and it also takes 38 States currently to ratify an amendment and a time limit of 7 years is imposed for it to be ratified or cease to exist.
An alternate way for the People to use the Sates to fix the mess the Federal Government has become is to use the Convention of States protocols https://www.conventionofstates.com/  That way the States propose an amendment worded exactly the same, endorsed by 38 States and present it to Congress. At that point Congress must send it out to the 50 States for an official (Pro-Forma) Ratification for it to become law. Since 38 States already have endorsed it the Ratification process will be quick but must be done to comply with Constitutional Law. In fact the Ratification process is the peoples protection from a hijacked Amendment Convention.
Other safeguards the public can and should enact within their own States can be found in the model from Indiana;
and
 
 The model does not have to be exactly worded that way but it's intent should be followed so the peoples actual desires will be followed by their elected officials.
The second is a highly definitive site on the original intent of the 14th amendment and how it has been systematically and deliberately misinterpreted over the years since it's ratification. It needs to be read and understood.

Congress hasn't done it's job since June 4, 1942, when they last formally declared war against a foreign enemy. They have since deferred their duties to the presidency and/or the United Nations.  This despotic relationship has had us mired down in undeclared wars and nation building since 1945. We have been in a state of war with North Korea since Jun 25, 1950, that conflict lasted  from Jun 25, 1950 – Jul 27, 1953 with a UN brokered ceasfire and no U.S. signatories . The Korean Armistice Agreement is the armistice which ended the Korean War. It was signed by U.S. Army Lieutenant General William Harrison, Jr. representing the United Nations Command (UNC), North Korean General Nam Il representing the Korean People's Army, and the Chinese People's Volunteer Army.

Ever wonder why we've been stuck in these crappy undeclared wars? You can blame the past 72 years on the events of Yalta and Potsdam. Not the Soldiers, Sailors Airmen and Marines who fought the proxy wars for the succession of presidents and the spineless Congress.

The items in the the 14th regarding voting and citizenship are in the original Constitution. There is no reference to sex or race of citizens . . so it was a political move by the North to forever control the South. "no State shall" was a stake in the heart of Federalism. I agree that the article should be in the site there is no single power like repetition and restating the facts.

And This;

The Supreme court usurped powers not given in Article III but grabbed by Chief Justice John Marshall in two cases - Marbury V Madison and McCulloch V Maryland. He took invented powers of Judicial Review and then Implied Powers. There is no language inside the four corners that give the courts those powers.

When I asked him if it should be put on the ArticleV site this was his response;

It has merit for discussion - keep in mind that in the Founders papers where they gave the power of the Purse to the Legislature - the power of the Sword to the Executive - THEY GAVE THE COURTS POWER OVER NONE.
