Murray Energy Corp. has filed the first lawsuit against the Obama administration’s new ozone rule.
The coal giant sued the Environmental Protection Agency (EPA) over its surface level ozone standards after they were published in the Federal Register on Monday.
“This ozone rule is yet another illegal and destructive action aimed at killing [coal industry] jobs," Murray CEO and president Robert Murray said. "We have the law, science, economics, cold hard energy facts and the Constitution on our side. We will continue to fight to preserve our jobs and livelihoods, and we will prevail in our litigation.”
Federal regulators formally introduced their new ozone standards on Oct. 1, tightening the acceptable level of surface ozone from 75 parts per billion to 70 parts per billion.
Industry groups have warned the new standard will be expensive to implement and threaten jobs. Murray said the rule threatens to prematurely shut down coal plants around the United States.
The Obama administration published the ozone standard in the Federal Register on Monday, the procedural step that opens the door to lawsuits. Industry groups have long promised to sue over the ozone rule, and public health organizations looking for an even stronger standard have said they’re considering the same.
The EPA has defended the rule as both attainable and designed to benefit public health.
“I need to do what’s requisite — not too high and not too low — and it’s very challenging, there’s no bright line,” EPA administrator Gina McCarthy said when unveiling the standards earlier this month.
“But I used as much thought and reason on how we could actually identify health impacts that we could eliminate and also pay attention to the direction we need to head with our remaining concerns.”
Beyond legal action, Republican lawmakers have promised to take action against the rule as well.
"I have always been an advocate of cleaner air, but this new regulation was unnecessary," said Sen. James Inhofe (R-Okla.), the chairman of the Senate Environment and Public Works Committee.
"I will be working with my Senate colleagues in pursuing legislation to protect American taxpayers from EPA’s aggressive regulatory agenda.”

Sen. Rand Paul (R-Ky.) is warning that democratic socialism, embraced by fellow presidential hopeful Bernie Sanders (I-Vt.), can lead to a government that will “exterminate” people who step out of line.
"I've been trying to point out — I'm on a lot of college campuses, we have a big following on college campuses — there’s nothing sexy and there’s nothing cool about socialism,” Paul said in response to a question about Sanders, whose rise in the Democratic presidential contest has been fueled in part by support from college campuses.
“What there is, is the implied force that goes with taking away your choice,” Paul (R-Ky.) said on TheBlaze radio network’s The Glenn Beck Program.
“Only the state tells you what you can do, it’s the most anti-choice economic system,” Paul said. “If you don’t listen, they fine you. If you don’t pay the fine, they imprison you. If you will not listen, ultimately, what has happened in history, people get mad when I say this, but they exterminate you. That’s what happened under Stalin.”
Historians estimate that tens of millions of deaths can be attributed to Stalin’s harsh rule of communist Soviet Union.
Paul pushed back against those who argue that democratic socialism is different.
“People say, ‘Oh, no, no, he wants democratic socialism.’ The problem is, a majority can be just as bad as one single authoritarian and that’s why we shouldn’t allow any of our rights to be subject to a majority.”
Sanders, who is running for the Democratic presidential nomination, has been open about his identification as a democratic socialist.
“We are going to win because we are going to explain what democratic socialism is,” he said during this month’s first Democratic debate. “What democratic socialism is about is saying that it is immoral and wrong to say that the top one-tenth of 1 percent in this country own almost as much wealth as the bottom 90 percent.”
Hillary Clinton, Sanders’s main rival for the Democratic nomination, immediately shot back, arguing that while America must reign in inequality, “we would be making a grave mistake to turn on what made the middle class great.”

FBI director James Comey argued this weekend during a talk at the University of Chicago that scrutiny of police conduct and the threat of exposure through “viral videos” has generated a “chill wind blowing through American law enforcement over the last year.”
** Murder rates are up across the country since the Obama endorsed Black Lives Matter movement took off last year.
Police officers today are under constant threat of exposure and abuse since the violent #BlackLivesMatter movement formed after the shooting of robber Michael Brown.

FBI Director James Comey has been talking a lot this past weekend about the police and #BlackLivesMatter, specifically about why officers are more reluctant to do their jobs “in the age of viral videos.”
In a speech to the University of Chicago Law School, Comey said there is a “chill wind that has blown through American law enforcement over the last year,” partly due to people taking out their cell phones and “taunting” officers as they record them doing their jobs.
He said one police leader “urged his force to remember that their political leadership has no tolerance for a viral video,” and officers need to keep doing their jobs as normal in order to keep their communities safe.
Comey is talking about what is colloquially referred to as the “Ferguson effect,” cops not doing their jobs out of worry about being overtly scrutinized.Comey elaborated today at the International Association of Chiefs of Police annual convention:

Businessman Donald Trump torched the media today during his New Hampshire town hall event on The Today Show.
Trump on the media:
“The Des Moines Register is a terrible paper. No, it really is. A very liberal paper by the way. I believe I am winning in Iowa. By the way, there are other polls that say I am winning in Iowa by the way. This was two small polls. And all over the country I am winning by massive numbers. But, I will say I think I am winning in Iowa> I’m doing really well with Evangelicals, the Tea Party, everyone else… The media has a lower approval rating than Congress. And you’re right, they’re scum. They’re horrible people.”
Trump went on to say Hillary traveled a lot and must have wanted to get away.

Donald Trump came out swinging with the media, Jeb Bush, and John Kerry among the real estate mogul’s targets during an early morning rally inside a packed ballroom in Atkinson, NH.
“One thing you will learn about the media, they’re the worst,” Trump told the crowd, as he blasted a recent Des Moines Register poll which has him trailing Ben Carson in Iowa. “I’m winning every single state, I’m winning big nationally … this one crummy poll, that’s all you hear about.”
The 35-minute speech also featured attacks on Democratic frontrunner Hillary Clinton and fellow GOP candidates like Bush and Carson.
“Under Hillary Clinton, the entire world blew up,” Trump said. “I give her credit for one thing, she traveled a lot…I guess she wanted to get away. … If she didn’t travel at all and got good results, I’d love her.”

Judge Andrew Napolitano argued Monday recovered documents prove former Secretary of State Hillary Clinton repeatedly lied under oath last week in front of the House Select Committee on Benghazi.
Judge Napolitano accused Hillary of repeatedly lying and misleading Congress:
It’s not only a crime to lie to Congress under oath, it’s a crime to mislead Congress. And, as Senator Cornyn just pointed out, she persists in misleading Congress about what she knew when. The FBI was also looking for something they call ‘bad acts,’ in her case the natural proclivity to lie either under oath or not. I heard her say to Congressman Pompeo from Kansas, “Mrs. Clinton do you know anything about the distribution of weapons to rebel groups?” Answer, “No.” Not only did she know about it, not only did she orchestrate it, but I have seen, anybody can, they’re public documents, her personal written authorizations to permit American arms dealers to sell arms to Qatar knowing they were going to be distributed to rebel groups in Libya.

The heavily redacted Defense Department “information report” says that the attack on the Benghazi facility “was planned and executed by The Brigades of the Captive Omar Abdul Rahman (BCOAR).” The group subscribes to “AQ ideologies:”
The attack was planned ten or more days prior on approximately 01 September 2012. The intention was to attack the consulate and to kill as many Americans as possible to seek revenge for U.S. killing of Aboyahiye ((ALALIBY)) in Pakistan and in memorial of the 11 September 2001 atacks on the World Trade Center buildings.
The documents obtained by Judicial Watch also show that Hillary Clinton knew that weapons were being shipped from the Port of Benghazi to rebel troops in Syria. An October 2012 report confirms:
Weapons from the former Libya military stockpiles were shipped from the port of Benghazi, Libya to the Port of Banias and the Port of Borj Islam, Syria. The weapons shipped during late-August 2012 were Sniper rifles, RPG’s, and 125 mm and 155mm howitzers missiles.
During the immediate aftermath of, and following the uncertainty caused by, the downfall of the ((Qaddafi)) regime in October 2011 and up until early September of 2012, weapons from the former Libya military stockpiles located in Benghazi, Libya were shipped from the port of Benghazi, Libya to the ports of Banias and the Port of Borj Islam, Syria. The Syrian ports were chosen due to the small amount of cargo traffic transiting these two ports. The ships used to transport the weapons were medium-sized and able to hold 10 or less shipping containers of cargo.

Cesar Vargas—an activist and undocumented immigrant able to work in the U.S. due to President Obama’s Deferred Action for Childhood Arrivals program—accepted a job with the Sanders campaign last week, according to multiple reports. “I joined the campaign because the senator believes not only that we should meet DREAMers but that DREAMers should be part of the conversation to champion policies for the Latino community,” Vargas said in a statement to BuzzFeed News.
Either Rubio or Bush would be considered a favorite for Florida’s delegates. With both on the ballot, though, the odds of another candidate winning Florida increase. Currently, Rubio is third and Bush is fourth in Florida. Their combined vote, 24 percent, would narrowly lead the field, however.
The Republican establishment needs one of the two to drop out before the Florida primary vote on March 15. It can withstand outsiders doing well in the early states, if the large, winner-take-all primary states fall back into the Republican fold. Combining some early state wins with the larger states in late March, however, would put the nomination far out-of-reach of the Republican establishment.
