A new report by the Center for Immigration Studies found there is a record 42.1 million Americans in the United States today.

The Washington Examiner reported:

A new analysis of legal and illegal immigrant counts by the Census Bureau revealed Thursday that there is a record 42.1 million in the United States, an explosion that is being driven by Mexicans flooding across the border.

In a report provided to Secrets by the Center for Immigration Studies, the total immigrant population surged 1.7 million since 2014. The growth was led in the last year by an additional 740,000 Mexican immigrants.

The 42.1 million tabulated by Census in the second quarter represent over 13 percent of the U.S. population, the biggest percentage in 105 years.

What’s more, the numbers of immigrants coming and going from the U.S. is actually higher since many return home every years, said the report. “For the immigrant population to increase by one million means that significantly more than one million new immigrants must enter the country because some immigrants already here return to their homeland each year and natural mortality totals 250,000 annually,” said the Center.

Then there’s this– 80% of California illegal immigrant families live in poverty and need government assistance.

CUBAN IMMIGRATION TO U.S. SPIKES AS OBAMA NORMALIZES RELATIONS

The Obama administration’s effort to normalize relations with Cuba is generating a surge in immigration from the island nation to the U.S.

In the first nine months of fiscal year 2015, 27,296 Cubans entered the U.S. through official ports of entry according U.S. Customs and Border Protection data reported by the Pew Research Center.

That level of immigration represented a 78 percent increase over the same timeframe the prior year, when 15,341 Cubans entered the U.S. Pew notes that those figures are much higher than the entire fiscal year 2011 when just 7,759 Cubans entered the U.S.

“The spike in the number of Cubans entering the country came in the months immediately following the president’s announcement. From January to March 2015, 9,371 Cubans entered, more than double the 4,296 who arrived during the same time period in 2014,” Pew reports.

Pew’s analysis of the dramatic increase in the level of Cuban immigration to the U.S. comes in the wake of a recent expose from the Florida Sun Sentinel which revealed the extent to which a number of Cuban refugees in Florida have been abusing the U.S. welfare system.

According to the Sentinel, Cuban immigrants have largely been deemed to be refugees fleeing persecution. As other refugees are, Cuban refugees are granted immediate access to welfare. The Sentinel’s investigation revealed that instead of using those public assistance as intended many Cuban refugees have using their benefits in Cuba.

“Cubans’ unique access to food stamps, disability money and other welfare is meant to help them build new lives in America. Yet these days, it’s helping some finance their lives on the communist island,” the report read. “America’s open-ended generosity has grown into an entitlement that exceeds $680 million a year and is exploited with ease. No agency tracks the scope of the abuse, but a Sun Sentinel investigation found evidence suggesting it is widespread.”

Pew’s analysis makes no mention of the Sentinel’s expose. Pew did note that currently about 2 million people of Cuban decent live descent, 57 percent of whom are foreign-born.

Increasingly, U.S. IT workers are alleging discrimination

Discrimination by national origin challenges H-1B use

Some U.S. IT workers who have been replaced with H-1B contractors are alleging discrimination and are going to court. They are doing so in increasing numbers.

There are at least seven IT workers at Disney who are pursuing, or plan to pursue, federal and state discrimination administrative complaints over their layoffs. Another Disney worker, still employed by the firm, has filed a state administrative discrimination complaint in California. These complaints are a first step to litigation.

Separately, there are ongoing court cases alleging discrimination against two of the largest India-based IT services firms, Infosys and Tata Consultancy Services. The federal judges in each of cases have given a green light for the plaintiffs to proceed after rejecting dismissal efforts.

There may be federal interest in examining this issue. The U.S. Department of Justice's Office of Special Counsel for Immigration-Related Unfair Employment Practices was asked by 10 U.S. senators in April to examine the IT layoffs at Southern California Edison (SCE) and to determine whether SCE or its contractors were "engaged in prohibited citizenship status discrimination."

What's being challenged, in sum, is the job replacement system created by the H-1B program. U.S. IT workers, as a condition for their severance, are being made to train H-1B visa-holding contractor replacements to take over their jobs.

The contractors often work for IT services firms that employ large numbers of H-1B workers. Most of these workers are from India and regional countries. This practice of replacing U.S. workers with foreign workers constitutes national origin discrimination, say its critics.

The court case against Tata, whose plaintiffs include a former SCE employee, alleges that some 95% of its employees are South Asian or mostly Indian. Tata has called the allegations baseless.

The Disney IT workers "were terminated because they were American citizens and all their replacements were foreign-born Indians," said Sara Blackwell, a Florida attorney, who is representing seven of the Disney workers at its parks and resort division. She has set up an organizationto challenge the practice. Other discrimination claims, including age and disability, will be made as well. Those complaints are being filed with the U.S. Equal Opportunity Commission, which sees if a settlement is possible prior to any lawsuit.

Disney did not respond immediately for comment.

"We need to protect American workers," said James Otto, a California attorney who is representing a Disney ABC Television Group employee in that state. This complaint is being filed in California under the state's Fair Employment and Housing Act, which Otto said is similar to the federal process, but with more protections.

Otto's client still works at Disney and had been targeted for an earlier layoff, but Disney rescinded those layoffs. Nonetheless, the complaints being made include a hostile workforce and national origin discrimination.

The IEEE-USA is trying to encourage the U.S. Department of Justice to take action and launch an independent investigation.

The engineering association held a forum this week at the U.S. Capitol and invited former DOJ officials, including John Trasviña, special counsel for Immigration-Related Unfair Employment Practices at the Department of Justice during the Clinton Administration, and William Sanchez, who led the same Office of Special Counsel as Trasviña during the George W. Bush Administration. Both agreed, according to a tape of the session, that the U.S. is in a good position to investigate.
