 Legal experts expected the judges to dismiss the ruling and uphold obumadon'tcare.

But two of the judges on the three-judge panel expressed deep hostility to attorneys defending obumadon'tcare.

 A panel of federal appeals judges aggressively questioned whether obumadon'tcare can survive during Tuesday afternoon oral arguments in a case that could upend the 2010 health care law.

 Two Republican appointees on the three-judge panel frequently interrupted attorneys to question whether the Affordable Care Act’s individual mandate is unconstitutional and if not whether the entire law could stand without it.

 The ACA’s future appeared murky after two hours of oral arguments at the 5th U.S. Circuit Court of Appeals, but it’s not clear if the judges were ready to uphold a federal judge’s earlier decision invalidating the law…

…Appellate Judge Jennifer Elrod, a George W. Bush appointee, on Tuesday posited that lawmakers — who failed to agree on an obumadon'tcare replacement plan two years ago — deliberately eliminated the mandate penalty because they knew the rest of the law would have to fall. She said perhaps lawmakers thought, “Aha, this is the silver bullet that’s going to undo obumadon'tcare.”

 This case is the third time the courts have had the chance to do the right thing and throw obumadon'tcare out.

 If the Fifth Circuit rules obumadon'tcare unconstitutional, there may not even be a Supreme Court case.

That’s because the administration – which must enforce obumadon'tcare – is arguing that the law should be thrown out.- And the proponents of obumadon'tcare may lack the standing to appeal the ruling.

 A group of Republican state Attorneys General won a shocking victory in a Texas district court where a judge ruled that because Congress zeroed out the individual mandate tax in the 2017 tax cut law, the entire obumadon'tcare law falls apart because the statute’s regulations and mandates depended on individuals being forced to maintain health care coverage.

 The Fifth Circuit Court of Appeals was all set to hear the case but the Republican state Attorneys General requested a three-week delay to prepare their case for oral arguments.

 The Daily Caller reports:

A coalition of red states led by Texas requested Monday that they receive 20 extra days to file a supplemental brief and a delay of opening arguments in a case they hope will overturn obumadon't care in front of the 5th U.S. Circuit Court of Appeals.

 “As of today, it appears unlikely that any such response will be completed by the Court’s July 3 deadline,” Texas Solicitor General Kyle Hawkins said in a letter according to Politico.

 The opening arguments were set for next week when Hawkins sent the letter.

The makeup of the three-judge panel was revealed Monday. Judge Jennifer Elrod, a George W. Bush appointee; 

 Judge Kurt Engelhardt, a Trump appointee; and Judge Carolyn Dineen King, a jimmy carter appointee, will hear the arguments, reported The Washington Post.

 Considering the makeup of the panel of judges that will hear the case – two Republican appointees and one Democrat appointee – there is a good chance the Republican states’ Attorneys General will win at the circuit court level.

 That would give conservatives a third – and final – chance at the Supreme Court to finally win a ruling that strikes down the unconstitutional obumadon'tcare statute.

**** CAN YOU IMAGINE THIS 'STUPIDITY' ?? ****

Last week saw a major victory for property rights and an end to another Endangered Species Act horror story.

The saga began in 2012 when the U.S. Fish and Wildlife Service determined that 1,544 acres of land in Louisiana was “critical habitat” for an endangered species known as the dusky gopher frog. 

As a result of this designation, the federal government was considering a ban on the development of the property, depriving the private property owners of $33.9 million.

The federal government continued to pursue this action even though the dusky gopher frog has not been seen in Louisiana in over 50 years.

The frog couldn’t even survive on the property. The only way the area could support the frog is if the private property owners make major and costly changes to the property—changes they have said they have no inclination to make nor can they be forced to make.

As the Pacific Legal Foundation’s Mark Miller, who represented the property owners, recently stated, “The feds may as well have labeled this Louisiana property critical habitat for a polar bear. It would have done just as much good.”

Unfortunately, in 2016, the 5th U.S. Circuit Court of Appeals held that the government’s actions were permissible. The implications of allowing such an area to be designated “critical habitat” would be sweeping. Judge Priscilla Owen in her dissent argued:

If the Endangered Species Act permitted the actions taken by the government in this case, then vast portions of the United States could be designated as ‘critical habitat’ because it is theoretically possible, even if not probable, that land could be modified to sustain the introduction or reintroduction of an endangered species.

In a unanimous 2018 decision (Justice Brett Kavanaugh did not participate), the Supreme Court rejected the 5th Circuit’s opinion, but didn’t actually answer the question about whether the area was “critical habitat.” Instead, it sent the case back to the 5th Circuit for its review, consistent with the Supreme Court’s opinion.

This included ensuring that the area is “habitat” for the dusky gopher frog before getting into whether it is “critical habitat,” and reviewing whether the federal government’s failure to exclude the area as “critical habitat” was permissible. The Supreme Court held that such exclusions are subject to judicial review.

For the property owners in Louisiana, though, the issue was still very much alive. 

But last week, maybe because the “writing was on the wall,” the Fish and Wildlife Service and the property owners settled the case, with the federal government dropping its efforts to designate the land as critical habitat for the dusky gopher frog.

This entire saga provides yet another example of how the Endangered Species Act and its implementation fail to conserve species while simultaneously hurting property owners.

The federal government wasted resources and attention to achieve an outcome that never would have helped the dusky gopher frog because the habitat wasn’t suitable for its survival. This entire misguided attack on property rights certainly appears more about restricting development than conserving the dusky gopher frog.

After 45 years, it shouldn’t be surprising that lessons have been learned regarding how to modernize and improve the Endangered Species Act and its implementation. Those lessons should be applied, not rejected, in order to save every word of a flawed statute and every misguided interpretation of the law.

This dusky gopher frog saga should serve as one of these important lessons.

Over Half of mexicano Voters Support Citizenship Question on Census!

The poll released earlier this month includes a finding that may surprise those who say adding the citizenship question to the 2020 census will result in minority communities not being properly counted.

 Among the mexicano registered voters polled in the survey sample for Harvard University’s latest national monthly public policy poll, 55% say they are in favor of adding a question about whether a census respondent is a citizen to the 2020 census.

 Additionally, the poll, released by the Harvard’s Center for American Political Studies and the Harris Poll, found 67% of all registered U.S. voters say the census should include a citizenship question.

 There were reports Thursday that President Donald Trump planned to announce an executive order to include a citizenship question on the census. Trump added to the speculation with a tweet:

"The White House will be hosting a very big and very important Social Media Summit today. Would I have become President without Social Media? Yes probably! At its conclusion, we will all go to the beautiful Rose Garden for a News Conference on the Census and Citizenship."

 Mike Gonzalez, senior fellow at the Allison Center for Foreign Policy at The Heritage Foundation, told The Daily Signal that this statistic on hispanic voters in the poll isn’t shocking.

“I’m not surprised at all,” Gonzalez said. “When you look at what Americans of Mexican, Puerto Rican, Cuban, Central American, and so forth background, the things they want are very similar to the things all Americans want.” 

However, Gonzalez cautioned that the term “hispanic” is very broad, and says little on its own:  

 ‘hispanic’ is a pan-ethnic category that doesn’t explain much about who people are. You have people who are very conservative, like Mexican Americans from parts of Texas. They’re very conservative if you compare them to Puerto Ricans in the North East. It’s a statistic that is interesting, but doesn’t really tell you much in terms of who we’re talking about.

 On Monday, House Speaker nancy pukelosi derided talk of including a citizenship question in the 2020 census as “disgraceful,” and said the president wants to include the question in order to “make America white again,” according to a report in the Washington Examiner. **** NOT A 'BAD IDEA' !!! **** Bull

Gonzalez called this “ridiculous.” “The left tries to bring race into everything,” he said. “We should ask Ms. pukelosi what she means by that. Does she equate citizenship with any race or ethnicity? It’s the opposite. Citizenship is colorblind. Citizenship is race blind. Citizenship is belonging in the United States no matter what your background is, or your pigmentation, the color of your skin. It’s about saying you’re a member of the polity, a member of this great nation.”

 Organizations like the National Association of Latino Elected and Appointed Officials, Mexican American Legal Defense and Educational Fund, and Asian Americans Advancing Justice push the idea that hispanics will be “undercounted” if a citizenship question is included, Gonzalez said.

 He says they fear hispanic people living in the United States won’t want to respond to the census at all due to the existence of the citizenship query. **** OF COURSE NOT-- THEY ARE HIDING! **** Bull

 This assumption, Gonzalez said, is actually much more racist than the U.S. wanting to validate the citizenship status of all its residents. “That includes how many assumptions about the nature of ‘hispanic households’?” he asked.

Gonalez has pointed to the irony of the census asking questions about race, ethnicity, and sex, yet a question about citizenship is considered by some as racist??

 “We ask questions on a census we shouldn’t be asking, and yet the one colorblind identity question that we could ask—which is, ‘Are you a citizen or not?’—that’s racializing things?” he said.

 In January, the Trump administration asked the Supreme Court to hear a case on including the citizenship question in the 2020 census after a federal judge in New York ruled the Census Bureau could not include the question.

 The Supreme Court sent the case back to lower courts, suggesting it might once again review the case, if the Trump administration offered new reasons for wanting the census question.

 Writing for the majority, Chief Justice John Roberts wrote, “Unlike a typical case in which an agency may have both stated and unstated reasons for a decision, here the Voting Rights Act enforcement rationale—the sole stated reason—seems to have been contrived.”

The Voting Rights Act was passed in 1965 to protect the vote of racial minorities, including non-English-speaking American citizens.

 Attorney General William Barr announced on July 9 that the president would be pursuing avenues to legally include the citizenship question in the 2020 census.

 As of Tuesday afternoon, Barr has not specified what this legal avenue would look like, though AP reported a senior official said the president is expected to issue a memorandum to the Commerce Department, instructing the inclusion of the question.

 Gonzalez said he thinks it’s “definitely possible” the question will be included in the end.

Trump Administration Preparing to Arrest Illegal aliens in Nationwide Raids!

The Trump administration reportedly plans to renew the operation to apprehend and deport thousands of illegal immigrants who have ignored court orders. **** KEEPING AMERICA GREAT !!****

 The White House is reportedly picking plans back up to apprehend and deport thousands of illegal immigrants who have ignored court orders to leave the country.

 Immigration and Customs Enforcement on Sunday will launch raids across major U.S. cities, according to Homeland Security officials who spoke with The New York Times and NBC News.

 The Sunday raids will target roughly 2,000 illegal aliens who, despite court orders to leave, continue to remain in the U.S. Targeted cities include Los Angeles, New York, Chicago, Miami, and others.

 President Donald Trump in June announced plans to deport “millions” of illegal immigrants, but he later postponed those plans, telling the public he wanted to allow time to negotiate with congressional Democrats on a solution to the immigration crisis. However, it is likely that the plans were also scrapped because key details were leaked to the biased media.The liberal Left continue to push their radical agenda against American values.

 The president has since said his administration was ready to renew the operation.

“These are people where we have their papers, we’ve gone through the court system. The deportations will be starting fairly soon, but I don’t call them raids. We’re removing people that have come—all of these people over the years—that have come in illegally. We are removing them and sending them back into their country!” Trump said on July 5.

 Ken Cuccinelli, the newly-appointed acting director of U.S. Citizenship and Immigration Services, also said that ICE agents were ready to apprehend and deport aliens who are ignoring court orders.

“They’re ready to just perform their mission, which is to go and find and detain and then deport the approximately 1 million people who have final removal orders,” Cuccinelli said during a CBS interview Sunday.

 The ICE raids are expected to last several days and also include “collateral” deportations—the apprehension of illegal aliens who were not original ICE targets, but happened to be at the scene.

If possible, family units who are arrested in unison will be taken to family detention centers in Pennsylvania and Texas, but some may be placed in hotel rooms.

 The goal, according to officials who spoke with The New York Times, is to deport families as soon as possible.

Iran Gives World Powers An Ultimatum To Avoid A Nuclear War!

Iran announced on Sunday they were hours away from breaching another aspect of the 2015 nuclear deal that was established. The country is planning to increase its amount of uranium enrichment, putting them over the cap established cap. 

 This puts Iran closer to establishing a nuclear bomb, although they still have a ways to go, the New York Times reported.

 The move is part of a bigger plan. According to Deputy Foreign Minister, Abbas Araghchi, Iran will continue to 'increase accord limits' over 60-day intervals until their country receives sanction relief.

From the Times:

 In violating the limits on uranium enrichment, Tehran still remains far from producing a nuclear weapon. It would take a major production surge, and enrichment to far higher levels, for Iran to develop a bomb’s worth of highly enriched uranium, experts say. It would take even longer to manufacture that material into a nuclear weapon.

 But for Iran’s president, Hassan Rouhani, who signaled in May that he would order the country’s engineers to cross both thresholds if Europe did not compensate Iran for American sanctions, the breach of the enrichment limit would be a watershed.

 He is betting that the United States will back away from crushing sanctions or that he can split European nations from the Trump administration, which the Europeans blame for setting off the crisis.

 If he is wrong, the prospect of military confrontation lurks over each escalation.

French President Emmanuel Macron asked Iranian President Hassan Rouhani to decide by July 15th if a new deal could take place. Rouhani agreed but said “lifting all sanctions can be the beginning of a move between Iran and the six major powers.”

 The Trump administration has placed pressure on Rouhani to come to the table to make another agreement, but one that places even more restrictions on Iran. President Trump made the decision in 2018 to remove the United States from the Iran nuclear deal, although some European countries are still part of the pact. Instead of staying with the agreement, Trump has slapped additional sanctions against Iran. The move came after Iran shot down an American drone.

Nike ignited an uproar when they made the cowardly decision to pull their sneakers featuring an early version of the American flag.- They made this decision when colin kaepernick called the flag on the shoe “offensive.”

But kaepernick’s demands have cost Nike millions!!

 Once Nike announced their decision to take the patriotic shoes off the market, people were furious.

 Many Americans were upset that Nike was afraid to show even a little patriotism, especially during the week of Independence Day.

 That’s when Arizona Governor Doug Ducey threw the hammer down. He tweeted that he is ordering the Arizona Commerce Authority to remove all financial incentives for Nike’s manufacturing plant in the state.- ABC 15 Arizona reports:

 In a series of tweets early Tuesday, Arizona Governor Doug Ducey announced that he has ordered the Arizona Commerce Authority to withdraw all financial incentive dollars to encourage Nike to add a manufacturing plant in the Valley.

 Governor Ducey’s decision stems from a Wall Street Journal report that said former NFL quarterback-turned-social justice activist colin kaepernick convinced Nike to pull its sneakers featuring an early American flag commonly known as the Betsy Ross flag. kaepernick reportedly found the shoe to be offensive.

 It was not immediately clear if the move, which Governor Ducey announced on Twitter at 2 a.m., would derail Nike’s plans for a $185 million factory in Goodyear. Ducey’s tweets were published hours after the Goodyear City Council approved more than $2 million in tax breaks over five years, but the governor has no control over those incentives.

 colin kaepernick’s demand that Nike pull the shoe, featuring the Betsy Ross flag proves his anti-American protests were never about police brutality.

 His protest has been and always will be about disrespecting the American flag and what it stands for.

Mexico Puts Demwitocratic Congress to Shame with Stunning Border Move.

The border situation continues to deteriorate, with thousands of migrants demanding asylum into the U.S. Many more try to cross illegally, being apprehended and released into the country. Congress is close to passing a weak bill to help the issue—loaded with Demwitocrat traps to make the problem worse.

Meanwhile, Mexico is shaming our own demwitocratc lawmakers with a stunning show of support at the border.

 Vice President Pence recently slammed Demwitocrats in Congress when he said that Mexico was doing more to help the border crisis than they were. He was 100% correct.

 As more and more migrants bombard our Southern border, Demwitocrats in the House put their fingers in their ears and ignore it. They would rather see our nation fall apart, than do anything to fix this problem.

 For months, President Trump has called on Congress to pass a bill that would fix our immigration loopholes and provide funding for the border. Demowitcrats instead have ran bogus investigations against him in the hopes of impeaching the president. Their lack of willingness has been shocking! And don’t think Americans haven’t noticed.

 Now, after Trump threatened to take drastic action to deport millions, Democrats are trying to pass a pathetic bill that neglects key funding. Worse still, they are trying to force through plans that would make our immigration system even weaker. President Trump has struck back with a threat to veto whatever they pass.

 The White House threatened late Monday to veto a $4.5 billion House bill that would provide emergency funding at the border over concerns that legislation in its current form lacks certain funding and includes provisions thrown in by Demwitocratic lawmakers “that would make our country less safe.” [Source: Fox News]

 The House bill refuses to provide funds for our detention centers. According to some reports, pukelosi is trying to put in provisions that will allow illegal immigrants and asylum seekers to use kids as props to bypass our vetting process.

 Once again, Demwitocrats are trying to make the situation worse. Instead of cooperating with the president, they still want to undermine the border crisis. These people nuts? They are so corrupt, they won’t even pass a basic bill to help Americans?

 Meanwhile, Mexico announced even bigger steps they are taking to protect our border and fulfill their end of the deal.- “Mexico has deployed almost 15,000 troops to the US-Mexico border to curve migration flow,” CNN reporter Nick Valencia tweeted. “An additional ~2,000 National Guardsmen have also been deployed across the country’s southern border with Guatemala & Belize.: MX Secretary of Defense Luis Sandoval.” [Source: Daily Wire]

 Mexico is sending nearly 15,000 National Guard troops to our border to address the migrant crisis.That is a seriously large force. Even Valencia from CNN had to say he’s “never seen this kind of cooperation from Mexico before.”

 Mexico has already sent thousands of troops to secure their Southern border with Guatemala. They have pleaded to build more detention centers on their own land. Also, a new policy is being enacted that will require asylum seekers to apply for asylum in the first country they reach. For most, that is Mexico.

All this will significantly curtail the massive influx of migrants coming to the U.S. In short order, we could see the crisis come to an end.

 None of this has happened because of Demwitocrats in Congress! If they had their way, we’d have no border.  Hundreds of thousands of migrants would invade our country. We’d be overrun. Our communities would be in shambles.

 When they are asked to pass a simple bill, they use it as a chance to make the problem worse.

Yet Mexico, which historically hasn’t done anything to help our immigration problems, 'now' is doing an incredible job of helping.

 What does that say to you about the kind of people in Congress? They have less concern for Americans than the Mexican government.

 Trump has effectively cooperated with the likes of North Korea, the Middle East, and Mexico.

Yet demwitocratic members of his own government continue to cause serious problems.

 How more pathetic can the Demwitocrats get? I guess we’ll just have to wait and see.

 Illegal Aliens Panicking as ICE Director Vows This Major Plan.

President Trump shocked Democrats when, a few weeks ago, he promised to make a powerful move against illegal immigration. Democrats pleaded with the president not to do it. They even passed a border funding bill just to appease him.

 But the troubles at our border are far from over. And acting Immigration director promises, they’re ready to act.

It may seem odd to the average American that Democrats are so opposed to protecting our borders. Everyone can see how unchecked, illegal immigration harms our country. Aside from the massive problems it creates for national security and crime (thanks to many drug cartel members getting in), illegal immigrant labor takes jobs from hard-working Americans.

 Demwitocrats should care about that, right? After all, Americans hurt the most by illegal immigrant labor are blue-collar, union workers. Yet these days, Demwitocrats do everything in their power to aid illegals—by helping them get into the country and protecting them while here.

 I’m surprised there’s any unions left supporting Democrats.

For over two years, President Trump has fought to end the crisis of illegal immigration. He’s spent tremendous amounts of energy and effort to secure our border and root out criminal aliens. Thanks to his efforts, job prospects for Americans are high. Companies are working hard to hire and keep good American workers. This is a direct result of Trump’s policies, which have reduced the number of illegal labor available to companies.

 But he still has to fight hard to get anything done in D.C. The most recent funding bill passed by Congress to address the border crisis only happened, because Trump made a shocking promise. He announced that ICE was going to deport over a million illegal aliens.

  Desperate to protect their pawns, Democrats agreed to pass a funding bill. So, Trump delayed the deportations.

It seems, though, that the deportations are coming anyway.

 Acting United States Citizenship and Immigration Services (USCIS) Director Ken Cuccinelli says the Immigration and Customs Enforcement (ICE) agency is ready to deport about a million illegal aliens who remain in the country despite having final orders for deportation.

 “ICE agents are ready to just perform their mission which is to go and find and detain and then deport the approximately one million people who have final removal orders. They’ve been all the way through the due process and have final removal orders. Who among those will be targeted for this particular effort or not is really just information kept within ICE.”

 Cuccinelli said mass deportations by ICE of illegal aliens with final deportation orders “should be going on a rolling basis” and blamed “the politics of Washington” for interfering with ICE operations. [Source: Breitbart]

 These illegal aliens have already been through the court process and have been found ineligible to stay. They came here illegally (or overstayed their visas), but refused to comply when our government said they should leave.

 Many of them benefited from obuma’s catch-and-release policy. They were caught and processed for illegal entry. But were released—making it easier for them to hide & stick around.

 Illegals have had it easy for many years. They thought they could get away with ignoring our laws and jeopardizing our communities. The broken system only encouraged more illegals to come.

 As Cuccinelli said, deportations should be happening all the time. Yet it’s corrupt swamp dwellers in D.C. that always seem to delay or divert the process. Demwitocrats don’t want illegal immigrants getting deported. 

 They don’t care how much Americans are hurt by this problem!!

But Trump’s Immigration director is done with the left’s games. He is planning on getting rid of these aliens once and for all.

 Trump gave them a slight delay—but the deportations are coming.

This is crucial. It will show the rest of the world, especially migrants at the border, that the United States will protect its people and uphold our laws. These deportations will discourage more people from trying to jump the fence.
