Urgent “To Do” List For Trump For Emergency Border Wall.

 12/15/19  By Jonathon Moseley

The following “to do” list needs to be on President Donald Trump’s desk this morning before mistakes are made in the implementation of a border wall built with emergency funds.  With the fast-moving news, if it is not too late already, there is great risk of snatching defeat from the jaws of victory.

1)  Take the weekend to get it right.  It is not enough to do the right thing.  One must do it the right way.  Especially with controversial actions that are certain to be tested in court, the details matter.  PUT DOWN THE PEN and take another 96 hours until Tuesday morning.

2) Do not sign the budget deal.  (It will probably be too late by the time anyone reads this.)  There is concern that it could weaken or even destroy the President’s ability to declare an emergency to fund the border wall mandated under the Secure Fence Act of 2006.

 Some of the 140+ limitations and poison pills marbled through the corrupt budget deal just worked out could seriously repeal Trump’s authority to declare an emergency to fund the wall.  Trump should not sign the budget deal until the money is already reprogrammed under an emergency.

 

3)  Don’t declare a national emergency —  today.  Wait a few days.

Government workers will mostly be off for the weekend plus President’s Day on Monday.   Government employees won’t be back to work until Tuesday morning anyway.

4)  (VERY IMPORTANT.) First, Texas must ask for an emergency.  Most emergencies are requested by a State’s Governor.  While a president does have the power to declare an emergency under the National Emergencies Act of 1976 without being asked, in this case Trump should notTrump must get on the phone confidentially behind the scenes and inquire if the Governor of Texas, Greg Abbott, will issue a request for a declaration of an emergency.

 The courts cannot stop Trump’s declaration of an emergency, if it is based upon a request from the State of TexasAbbott — when then Attorney General of Texas — already wrote letters to then resident barack obuma demanding immediate action.  He didn’t use the word “emergency” but what he said was essentially the same.

 Some may be cynical about whether Abbott was just posturing for the base.  But he is already on record writing letters to the then-President which lack only the word “emergency”  to be a request for an emergency.

5)  Sort out the details. The devil is in the details.  Document, document, document.  Trump should ask Texas’ Governor for a complete list of every incident, threat, example, and circumstance of gang violence, intrusions by coyotes, danger, drug smuggling, human trafficking, sex slavery, money laundering, etc.   The emergency must be supported with specifics.

6)  Trump should work with the Texas state legislature. He could ask the Texas legislature to invoke Article 4, Section 4 of the U.S. Constitution, which requires the federal government to defend the StatesRep. Briscoe Cain and Rep. Kyle Biedermann of the Texas House of Representatives are some of those taking the lead on this issue.

7)  Declare an emergency, but take action only in Texas.  Texas is in the Fifth CircuitActions in California, New Mexico, and Arizona go to the Ninth Circuit.  Understand that the declaration of an emergency can be separated from the specific actions taken under the emergency status.

8)  Reprogram emergency funds immediately under the authority of the emergency declaration before signing the budget deal bill.

NOTE:  It is said that Congress gets to overturn an emergencyWell, not exactlyThe National Emergencies Act of 1976 gives Congress the power to “terminate” a state of emergency.

That would mean that if Trump had already moved the money before Congress votes to terminate the emergency, then the money is “gone” — re-purposed to build the wall.

 The power of Congress is not to overturn the emergency — as if it had never happened.  The text of the National Emergency Act of 1976 talks about when the emergency ends. DUH 

 So if Trump has his Office of Management and Budget and Department of Defense people work all weekend and on President’s Day, and signs the paperwork at 7 AM on Tuesday morning when the government re-opens after President’s Day and then later that same day Congress votes to “terminate” the emergency, that would NOT invalidate the moving of the money already completed before they “terminate” the emergency.

 Furthermore, the courts cannot overturn an emergency.  The law commits the question to Congress.  Unless the courts break their own rules, the courts cannot consider the question.  The issue is “textually committed to another branch.”  \

 Since Congress has been given the power to end an emergency, the courts have been deprived of any authority.  It is purely a “political question” committed to Congress.

 9) Sign the budget bill only after the funds have already been reprogrammed under the declaration of an emergency.  Keep the budget people working all weekendThe budget deal cannot stop the reprogramming of funds under the emergency declaration after the money has already been moved over to fund the border wall.

NOTE: There is significant cause for concern that all of the limitations and poison pills in the budget deal bill could cancel Trump’s authority to build the border wall by emergency declaration.  

 Move the money first (this weekend) before signing the budget dealIf the money has already been moved, the budget deal cannot stop it.

10) Don’t worry about the courts.  Well, no.  Fear the courts when it comes to being meticulously careful in doing it right —  Then ignore them.  Trump needs better legal advice and help to carefully plan the strategy and implementation and navigate the land mines.  However, if the plan is done right, the courts cannot stop this.  No need to tip off the anti-American open border activists explaining why they are going to lose badly.

11)  Break up the building of the wall into its constituent steps.

Many of the constituent steps can be accomplished without using “border wall” funding per se, but are normal tasks.

12) Order the Defense Mapping Agency and the National Imagery and Mapping Agency within DoD and  the U.S. Geological Survey within the U.S. Department of Interior to complete a comprehensive analysis and study of every mile of the border.

Most of that data already exists of course but it should be compiled into a mile-by-mile comprehensive analysis, designating each section by identification number, including satellite imagery, topography, and soil / geological conditions.

13) Order the Department of Defense to build an access road or upgrade existing roads, as needed, along the international border.  President Dwight Eisenhower spearheaded the interstate highway system as important for national defense, for moving troops and equipment quickly around the countryThe military needs to be able to access the international border along its entire length.

14) Dispense with the “designed to fail” wall designs. 

There are companies that can build vertical slats or Bollard wall designs (without the cap at the top, to frustrate climbing) right up to the banks of the Rio Grande.  If there is a road there, we can build he wall right next to the river.  The right way to do it is to SINK a steel “footer” deep into the ground (dig a trench) which has wings or feet out to the side.  That footer is buried deep into the ground, and then is buried.  Even in wet conditions, the wall will stand up on top of it above the ground.  Add concrete if you want, but that is not necessary.  Remember that underwater concrete exists.  So pretty much all that is needed is the ability to dig a deep and wide trench, transport of the steel parts, and to stand up the vertical slats on top of the (to be buried) footer.

15) Work around the butterfly fiasco to avoid unnecessary public relations problems.

Construction of the wall is about to cut through the North American Butterfly Center’s 100 acres because the builders are foolishly leaving 70 acres of U.S. soil on the Southern side of the wall.

 Invaders will cross the Rio Grande, set up a tent city with U.N. refugee monitors, reporters, birth tourism, and circus, in the 70 acre landing zone created by putting the wall in a stupid place.  There are companies that can put the wall right up next to the Rio Grande — not half a mile inland.  Ask James Bonk, who worked on the wall construction teams in 2006 to 2008.  There is already a road right along the Rio Grande.  The wall can be built next to the river.

16)  Incorporate irrigation canals or pipes to supply water to those ranchers or farmers who currently rely on the Rio Grande for access to water.

17)  Minimize unnecessary friction related to the use of eminent domain.

Do not take entire ranches or farmsPut the wall as close as possible to the Rio Grande.  Don’t take any more land than necessary.  Take an EASEMENT by eminent domain as a narrow strip along the border.

No one should have private ownership of the international borderIt is bizarre that this was ever allowed to developNo private landowner should expect to own land right next to the international border.  No such landowner’s complaints should be taken seriously when they knew that is our nation’s border.  But we will compensate them under the Fifth Amendment rules for eminent domain.  The value of their land will increase without gang violence and trespassers flowing across the border.  We should compensate them only for a narrow easement along the border itself.

Dear Mr. President,

Deadly violence from drug cartels and transnational gangs in Mexico is knocking on the United States’ door with ever increasing frequency. Yesterday, gunfire from the cartels pierced that threshold and struck City Hall in El Paso. Fortunately no one was injured or killed. But that good fortune was not the result of effective border control – it was mere luck that the bullets struck buildings rather than bodies.

Luck and good fortune are not effective border enforcement policies. The shocking reality of cross border gunfire proves the cold reality: American lives are at risk. As the attached news article notes: “More than 1,300 people have been murdered in Juárez this year as a war continues relentlessly between the Juárez and Sinaloa drug cartels.” Americans must be protected as this deadly war bulges at our border.

Law enforcement officials with the Texas Department of Public Safety and your own U.S. Customs and Border Protection will reveal the hard truth. Our state is under constant assault from illegal activity threatening a porous border.

The time for talk has passed. The time for action is now. The need is urgent. Each day that passes increases the likelihood that an American life will be lost because of the federal government’s failure to secure the border.

This threat demands immediate and effective action by your Administration to secure our border. As the Attorney General of Texas, I urge you to make border security your top priority so that no more innocent lives are lost to border violence.

Church Fire Leaves Bibles and Crosses Untouched by Flames.

God still works in miraculous ways.

 Firefighters that responded to a fire call at Freedom Ministries Church in West Virginia reported that in the midst of the devastating church fire, not a single Bible nor cross was damaged from the heat. The first responders indicated that at one point, the flames were so hot that the firefighters had to exit the building.

 The Coal City Fire Department Facebook post about the incident, that now has almost 50k shares, showed a picture of the untouched Bibles and said:

 “Though odds were against us, God was not. Picture this, a building so hot that at one point in time, firefighters had to back out. In your mind, everything should be burned to ashes. Not a single bible was burned and not a single cross was harmed!! Not a single firefighter was hurt! Prayers for the pastor and the congregation today.”

Trump’s Budget Will Include $750B For Defense, Money For Border Wall.

President Trump plans to include a significant request for border wall funding in his budget, according to a new report.

The Associated Press reported that the White House budget that will be released next week will include the request, along with $750 billion in defense spending and cuts to non-defense discretionary spending by 5 % that will keep the budget under strict statutory spending caps.

 President Trump had said in October that he would request $700 billion for defense, $16 billion less than his previous budget, and asked Cabinet members to cut their budgets by 5%. However, a showdown with congressional Democrats in December over more than $5 billion in appropriations for border security, including a wall, led to the longest partial government shutdown in U.S. history!

 The president declared a national emergency over border security in February, which will allow him to divert $8 billion of previously appropriated money for the wall. Approximately $6 billion of that would come from military construction and the Defense Department’s drug interdiction program.

 President Trump reiterated the need for a wall in a tweet Saturday, saying Border Patrol has apprehended many immigrants trying to enter the country illegally. “They won’t be coming into the U.S. The Wall is being built and will greatly help us in the future, and now!” he said.

 The president’s 2020 spending request, which is expected to be unveiled next week, is aimed at balancing the federal budget in 15 years. All appropriations are approved by Congress.

SOCIALIST BACKFIRE: This state Is on The Verge Of Going Bankrupt For First Time in 40 Years!

After decades of adopting and implementing socialist policies, New York City is on the verge of going bankrupt for the first time in nearly 40 years.

 According to Breitbart, financial experts are predicting — and warning — that there are signs that the city is headed for a financial disaster.

 The experts argue that many individuals and businesses leaving the city for lower tax areas coupled with city government spending being at an all-time high is also having a major effect on the Big Apple.

 The last time New York City almost filed for bankruptcy was in 1975, when former President Gerald Ford was in office and would not give the city a bailout package to settle its massive debt.

Here’s more from the Breitbart report:

 “The city is running a deficit and could be in a real difficult spot if we had a recession, or a further flight of individuals because of tax reform,” economist Milton Ezrati told the New York Post. “New York is already in a difficult financial spot, but it would be in an impossible situation if we had any kind of setback.”

 The city’s budget deficit has reached an all-time high over the past year. New York City’s long-term liabilities— including pensions, bonded debt, and retirement benefits for city government employees— reached a record-high $257.3 billion, according to an October 2018 Citizens Budget Commission report.

 Even though the city’s budget deficit has reached record highs, dumb assed Mayor bill de blasio has shown no signs of curbing the city’s spending. In fact, de blasio is adding $3 billion in spending to the current $89.2 billion budget, and spending money at a rate that is three times the rate of inflation, according to the Post.

 It also appears that de blasio will not get help from fellow Democrat Gov. Andrew Cuomo, who is trying to address a $2.3 billion state budget deficit by using auditors to bill wealthy residents fleeing the state for lower-tax regions. Cuomo’s preliminary budget proposed $600 million in cuts to money allocated to New York City.

 For starters, the Big Apple has been behind Rep. Alexandria Ocasio-Cortez’s socialist “Green New Deal,” which studies reveal could bankrupt the entire nation.

 One study revealed that the price tag for socialist measure comes out to $7 trillion, with another finding that it could actually cost nearly $50 trillion, which would be roughly seven times more than the original study.

 The same goes for the “Medicare for All,” another socialist idea that NYC has been behind.

A study from the Mercatus Center at George Mason University found that the “Medicare for all” plan would increase government health care spending by $32.6 trillion over 10 years.

 While getting “free” Medicare and health benefits sounds appealing, notable socialists fail to mention how taxpayers will be stuck footing the $32.6 trillion bill over 10 years.

 A second study from Vox.com revealed that the “Medicare for All” plan would cost the United States a jaw-dropping $218 trillion over the next 30 years.

 All of those socialist policies and agendas sure are expensive, and it could be pushing New York City into a total collapse.

obuma Shows His True Colors.

 Latest news

 In former resident obuma’s opinion, America and the entire world would be a much better off if millions of leaders were more like him and his wife.

 Giving a speech at Winnipeg’s Bell MTS Place arena on Monday, obuma outlined “plans to create a ‘university for social change’ that will serve as a hub for young people in the U.S. and around the world who are skeptical of the ‘old institutions,'” according to The Washington Examiner.

 “If we train them — if we give them skills, support, financing, media training, spotlights, then they’re the ones that are going to carry forward the solutions that we so desperately need,” obuma told the audience.

“If we could form a network of those young leaders, not just in the United States, but around the world, then we got something,” he continued. Hope is attainable “if we can train a million baracks and michelles who are running around thinking they can change the world,” he added.

 The 44th president’s narcissistic remarks are not out of the ordinary. obuma was often nailed by critics for constantly talking about himself and blaming others for his failings.

 According to Media Research Center, for example, obuma mentioned himself nearly 1,200 times in just 41 speeches during his first year in office:

 Instead of adoring his own image, obuma loves to hear himself talk – about himself. In just 41 speeches this year, Obama has talked about himself nearly 1,200 times – 1,198 to be exact. (That breaks down to 1,121 “I”s and just 77 “me”s.) And that just includes 34 weekly addresses and his seven major speeches. Count the hundreds of other public speeches and he’d be off the charts.

 More recently, obuma referred to himself more than 90 times during a 38-minute speech campaigning for fellow Democrats in October.

 In the same vein, during a speech marking his return to politics after Donald Trump took the 2016 presidential election, obuma entirely blamed the collapse of the nation’s social fabric and civic institutions on Trump.  Somehow, according to obuma, it is obuma who enhances civil discourse and it is everyone in disagreement with him who is the problem.

 “The reality of the situation, of course, is that Trump is a symptom of the slow-rolling collapse of those institutions, brought about in large part by the disingenuous gaslighting in which obuma engaged for a decade: promoting a better discourse while engaging identity politics, championing supposed honesty in politics while simultaneously presiding over an administration rife with malfeasance, and demonizing opponents while claiming to fly above the fray,” explained Daily Wire Editor-in-Chief Ben Shapiro.

 During his Monday speech, obuma refrained from speaking President Trump’s name, “but he did take a jab at Senate Majority Leader Mitch McConnell, R-Ky., provided a clue about how soon he might complete his first book since leaving office, and shared his admiration of Joe Biden, who was his vice president and is now looking at a bid for president,” reports The Washington Examiner.

Unable To Win, pukelosi Flips On Impeachment Talks.

 After countless attempts, House Speaker nancy pukelosi (D-CA) is finally calling it quits on trying to impeach President Trump. pukelosi even flipped her narrative with the Washington Post, telling them that “he’s just not worth it.”

 “Impeachment is so divisive to the country that unless there’s something so compelling and overwhelming and bipartisan, I don’t think we should go down that path, because it divides the country. And he’s just not worth it,” pukelosi told the Post.

 pukelosi’s remarks come as House Democrats are expanding their investigation into President Trump and his allies, having requested documents from over 80 individuals and entities regarding their finances and communications. Some lawmakers are hopeful their probe will uncover impeachable offenses.

 In addition to the speaker, other top Democrats have also voiced opposition to discussions about impeachment, including House Judiciary Chairman Jerry Nadler (D-NY), who has urged caution until the release of special counsel Robert Mueller’s report on his investigation into possible collusion between the Trump campaign and Russia during the 2016 election. Up until today, pukelosi publically agreed with Nadler, telling reporters last Tuesday that she first wanted to “see what the facts are, what the law is, and what the behavior is of the president,” before discussing impeachment.

  Now, it appears the California Democrat has all but written off the move.

Yet, some Democrats have signaled they will ignore House leadership and move forward with their own plans to bring impeachment proceedings against President Trump.

 In a recent appearance on MSNBC, Sen. Chris Murphy (D-CT) claimed the president’s actions have already “crossed the threshold of what was brought for impeachment” against President Richard Nixon. “What we know is that the president’s behavior has already crossed the threshold of what was brought for impeachment before the House in the Nixon administration and the clinton administration. In fact, he crossed those thresholds in the first weeks or months of office. And so, that is another means, if these other means fail, to control this president,” he said.

 Rep. Al Green (D-TX) announced last month that he will bring a vote on impeachment to the House floor for a third time, despite failing to hold a successful vote in 2017 and 2018. The Texas Democrat said he will propose the measure regardless of Mueller’s findings, vowing to “act on Trump’s bigotry.”

 Rep. rashida tlaib (D-MI), who previously faced rebuke for pledging to “impeach the motherfucker” — a reference to President Trump — recently said she will bring articles of impeachment by the end of March.
