As the news channels fight for relevancy against Fox News, one host is starting to shine even more. Fox News host Sean Hannity attracted more viewers than all of the other networks combined.
 According to The Daily Caller:
Fox News host Sean Hannity beat his primetime competitors in combined views during coverage of President Trump’s summit with North Korean leader Kim Jong Un in Singapore Tuesday.
 “Hannity” averaged 4.1 million views with his interview of the president after meeting with Kim. He garnered more views than both CNN and MSNBC combined. CNN netted an average of one million views with “Cuomo Primetime” and MSNBC had an average of 2.5 million views with “The Rachel Maddow Show,” according to Nielsen Media Research.
 “Tucker Carlson Tonight” and “The Ingraham Angle” also got the best of their CNN and MSNBC competitors on Tuesday. In daytime coverage, Fox News garnered more than 1.8 million views, while CNN had 716,000 views and MSNBC received just over one million views.
  On Tuesday in average primetime numbers, Fox News beat its competitors combined in views. Fox received almost 3.5 million views, while CNN and MSNBC combined received just above 3 million views.
 The left loathes Sean Hannity! He is a thorn in their side, and a majority of news consuming Americans love him.

Did President Donald Trump Really Promise To End Sanctions On North Korea?

It was nearly predictable that once the Trump-Kim summit was over that the North Koreans would spin the story to be as favorable as possible. There is a story in the Wall Street Journal today that basically says, according to North Korean media, that Trump gave away the farm:

 North Korea said Wednesday that President Donald Trump had told Kim Jong Un that he intended to halt U.S.-South Korea military exercises and lift sanctions against the North, suggesting through its state media that President Trump had explicitly acceded to two longstanding North Korean demands during bilateral talks at their summit meeting a day earlier.

 The report put a distinctly North Korean spin on the summit meeting between the two leaders, the first between a sitting U.S. president and a leader of North Korea, since 1953- 65 years.

  The report quoted Mr. Kim as saying that, if the U.S. were to take “genuine measures for building trust,” then the North could reciprocate in a “commensurate” fashion—a clear suggestion that U.S. concessions would have to come before any North Korean move.

The report also suggested that Mr. Trump had adopted the North’s preferred phased approach toward any denuclearization process, saying the two men had agreed to the “principle of step-by-step and simultaneous action.”

The North Korean report emphasized the equal standing of the two countries, describing the positioning of the two countries’ flags. It also said that the two men were able to enjoy “deepening friendly feelings” during a short stroll together.

None of this is terribly unsurprising. Kim’s performance in Singapore was going to be lauded by the same media that claim he was able to drive at age 3, won a yacht race at age 9, and shot a 38-un.... Kim is literally considered to be a deity and anything less than total success would be an affront to his divinity. Plus, Kim may be an autocrat but there is obviously unrest within the small group of families that have ruled North Korea as retainers to the Kim family since the 1950s. Just a week ago, several senior officers were suddenly replaced. By establishing the predicate of having gotten everything he demanded in Singapore, Kim has the political maneuver room to make concessions and not lose face…assuming that he is negotiating in good faith.

More to the point, there is no evidence that any of this happened.

And even though I don’t believe in a Chinese or Turkish style Deep State, there is no doubt that the federal bureaucracy is a Democrat fiefdom and the moment there is let up on sanctions we will hear it. The issue of military exercises is also muddled. It is clear both in summit context AND in the context of previous North Korean demands that the military exercises in question are not the day-to-day joint training but he large scale exercises like FOAL EAGLE and ULCHI FREEDOM GUARDIAN.

Interestingly, there is a real question if the North Korean media is actually putting the version the WSJ quotes out monolithically:I’m not a connoisseur of North Korean media but this says pretty much what the joint statement in Singapore says:

I had a DM with the WSJ reporter and he agrees with the translation and cautions that KCNA is a different kind of outlet.

 The basic delineation I’ve heard is KCNA is more for external audiences, Rodong for internal. But…not 100% sure about that. We’re guessing about the internal intentions and motivations and strategies of a regime we know very little about, unfortunately.

 This makes sense. Outsiders won’t know sanctions haven’t been lifted. Insiders will.

Expect to see a lot more of this, but let’s keep our eye on the tangibles.

Are sanctions in place?

Are they being enforced as they were before the summit?

Are there measurable and verifiable outcomes emerging from negotiations or is it just more hot air?

Federal Judge Had Role In Hero’s Suicide.

 Unlike Aaron Swartz (right), who rose on his own merits, Federal Judge Nathaniel M. Gorton (left) was apparently appointed to the bench as a political favor after his brother leveraged their inheritance for a position in the U.S. Senate.

 Federal Judge Nathaniel M. Gorton, of the old money Gorton’s Seafood fortune, has never apologized for his role in driving visionary technologist, pioneering innovator, and civic champion Aaron Swartz to suicide.

 Aaron was a prodigious self-made computer programmer whose civic projects and commitment to justice established him as a hero to millions, including to me.

  Unfortunately though, his story is commonly both misrepresented and misunderstood as the salient facts too often fall by the wayside in today’s deadline-driven, “less is more,” overly-politicized media landscape.

 But, especially looking across the chasm which seems to divide the left from the right in America nowadays, the distinctly non-partisan nature of Aaron’s goals and accomplishments command both a profound respect and a simply devastating sadness.

 Suffice to say that anyone who cares about the metaphorical little man and who fights for him over the government bureaucracy will eventually be confronted by those in power and Aaron was no different in that regard.

  His first known close encounter of the federal kind came as a result of his publishing public U.S. federal court records for free.

Now, you may be asking, if those records are public, then what’s the big deal about publishing them for free?

 The answer is that despite the fact that the records are public, the federal courts themselves still charge 10 cents per page to download them from their so-called “Public Access to Court Electronic Records” system, or “PACER.” That might not sound like all that much, but considering that there are often dozens or even hundreds of filings per case as well as that each such document can exceed 100 pages and therefore cost over $10 to download, PACER fees pose a significant barrier to citizens who wish to scrutinize federal trials which under the 6th Amendment are supposed to be public.

 Additionally, any system like PACER raises serious privacy concerns due to its ability to track exactly who downloads which documents. For example, if Jeff Sessions had gotten his way on cannabis enforcement then it wouldn’t have been hard to imagine the DOJ opening up investigations into those who had downloaded documents on cannabis cases.

 U.S. federal courts’ PACER (Public Access to Court Electronic Records) system, which faces longstanding scrutiny for both (over)charging and possibly tracking members of the public.

 The RECAP project republishes U.S. federal court documents for free at https://free.law/recap/.

Apparently such concerns led the founders of the RECAP project to feel that PACER (an anagram) was backwards. And apparently Aaron agreed with them, especially since the courts are supposedly limited by law to charging only nominal fees sufficient to maintain PACER itself but they instead seem to be charging far more than is reasonable.

 So, RECAP setup a free website as a public service where people can submit documents which they have already obtained from PACER in order for those documents to be made available to anyone anonymously for free. RECAP could legally do this because PACER documents are public records, and even though the courts are allowed to charge for the service of providing them through PACER, the documents themselves are exempt from copyright control and can be republished freely.

 However, it could have taken the folks at RECAP centuries to build up a respectable library by accepting documents piecemeal, a few here and a few there, from people going out of their way to share them.

 But then along came Aaron. Acording to Wired, he learned that as part of a pilot program launched with the help of the Government Printing Office, a small number of computers had been scattered across the country where members of the public could enjoy free unlimited access to the PACER system. He also discovered that unlike the vast majority of Americans, he just so happened to live close to one such machine.

 So Aaron wrote a simple computer program to rapidly download tons of documents from PACER and upload them to the cloud.  Over a relatively short period, he donated millions of pages of publicly owned PACER documents to RECAP.--When the folks at RECAP started receiving the documents which Aaron was sending to them, they were happily surprised. But when the feds figured out what Aaron was doing – and apparently that he was endangering their monopoly as well as possibly their ability to track who was accessing which documents – they hardly seemed amused. The free PACER pilot program ended up being suspended citing security concerns.

 Also, the FBI sent agents to reconnoiter the home of Aaron’s family. But there was little that they could do for the time being. After all, by design, the computer which Aaron had used allowed the public unlimited access to PACER and apparently he hadn’t violated any posted notices or bypassed any security mechanisms in order to run his program.

 As one of RECAP’s founders Carl Malamud later remarked, “I’ll grant you that downloading 20 million pages had perhaps exceeded the expectations of the people running the pilot access [PACER] project, but surprising a bureaucrat isn’t illegal.”

 Further, trying to prosecute Aaron would have called yet more unwanted attention onto the controversial fees which the courts were charging the public in order to access documents via PACER.

 However, the incident did cause the FBI to open up a file on Aaron. And over time it would get thicker.

Twice Deported Illegal Alien Re-Enters Country and Kills Daughter




Walter DaSilva, shot and killed Sabrina DaSilva in 2016 because he felt “disrespected.”

 Walter DaSilva, an illegal alien was sentenced to life in prison in New Bedford, Mass. on Friday after pleading guilty to the murder of his daughter.

 Walter DaSiIva admitted to shooting and killing his 19 year-old daughter because she continued to date an older man against his wishes. This apparently upset DSilva who felt further insulted when she refused to visit him on Father’s Day in 2016.

 Walter DaSilva had been separated from his daughter for a lengthy amount of time because he had also attempted to kill her mother, Lillian Silva, in 2002.

 Walter DaSilva spent 8-10 years in jail and then was deported back to his home country of Brazil. This was the second time that he had been deported. He was also removed from the country in 1999.

 In 2016, he returned to the States and quickly tried to reconnect with his daughter. He gave her many gifts, including $12,000. But, he told her not to see her 56 year old boyfriend. She ignored his request.

 “Based on that disrespect and that disrespect alone, as he saw it, he took upon himself to obtain a firearm in Connecticut,” the prosecutor said at the time of his court hearing in 2016. 

 After obtaining the firearm, he drove to his daughter’s house in New Beddord, MA on July 3rd, 2016 where he planned to kill the couple.

  But, he decided to kill only his daughter after the boyfriend was no where to be found once DaSilva arrived at the house. He was then arrested a month later and charged with murder

 At his court hearing in 2016, tWalter DaSilva,  an  illegal alien smiled with glee as his charges were read aloud. 

 “He just looked at my face and smiled. He was so happy for what he did,” his daughter’s mother told the Boston Globe. “It made me cry. He’s very cold and mean and evil."

 After nearly two years of legal procedure, DaSilva and his attorneys have reached a plea agreement. According to WWLP-22 News, "as part of the plea agreement, he will be eligible for parole after serving 25 years.

 DaSilva also pleaded guilty Friday to illegally carrying a firearm and possessing a loaded firearm...For the carrying charge he was sentenced to three years, which will be served prior to the life sentence, and for the possession charge he received a two-year sentence, which will be served concurrently with the life term."

 "It gives the family some comfort, some closure," one official said. "Not total. It's legal closure. They don't have to worry about any of the court proceedings, and he's going to be in jail very likely for the rest of his life."

 Sabrina DaSilva left behind her own daughter. She is now four years old.

You Can't Take 'Em: Judge Blocks Chicago Suburb's Gun Ban Hours Before Going Into Effect .

Zero hour was approaching for the law-abiding gun owners of Deerfield, Illinois. The village had banned the ownership of so-called assault weapons, which in reality meant AR-15 rifles and any other firearm that carried a detachable magazine capable of holding ten or more rounds. That’s how Deerfield defined a so-called assault weapon.

 On June 13, the anti-gun ordinance passed by the Chicago suburb would have gone into effect. It was essentially a gun ban, and there were no exceptions. It’s either you turn them over, move, or risk facing a $250-$1,000/ day noncompliance fee. The AR-15 and other rifles the anti-gun Left finds scary were banned, but it also included scores of handguns. Magazines holding 15 rounds are not uncommon.

 Luckily, a circuit court judge blocked this law 24 hours from going into effect. And yes, legal challenges were filed against this grossly unconstitutional law.

  BREAKING: NRA VICTORY! Lake County circuit court judge has issued a temporary restraining order BLOCKING enforcement of the Deerfield, IL, ASSAULT WEAPONS BAN.-- NRA

 A judge blocked a ban on assault weapons and high capacity magazines in the small town of Deerfield, Illinois, less than 24 hours before it was meant to go into effect. The decision, handed down Tuesday evening in the 19th Judicial Circuit Court in Lake County, Illinois, is a small victory for gun rights groups, who sued the Chicago suburb in April after it became the first municipality to ban assault weapons following the Parkland high school shooting. The Deerfield ordinance was passed unanimously by all six board members on April 2.

 Gun groups, including the National Rifle Association of Illinois, requested a temporary restraining order against the ban while the lawsuit proceeded. It’s not over.

 A proposed ballot initiative in Oregon would force AR-15 owners to register their rifles with the state, destroy them, or surrender them to the authorities. They would also have the option to transfer them out of the state.  Boulder, Colorado also passed a law banning high capacity magazines and so-called assault weapons within the city limits.

 The anti-gun Left is waging a war against the Second Amendment and the Constitution.

It will be greatly expanded if Democrats win the 2018 midterms, so don’t forget to vote!!

New DOJ Report: 1-in-5 Federal Prisoners are Illegal Aliens.

A new Department of Justice report released Thursday reveals 20% of federally incarcerated individuals in the United States are illegal aliens, costing taxpayers $1.5 million per day.

 Many of these individuals committed serious and violent crimes, in additional to entering the country illegally.

From the findings:

A total of 57,820 known or suspected aliens were in in DOJ custody at the end of FY 2018 Q1, including 38,132 persons in BOP custody and 19,688 in USMS custody. Of this total, 42,284 people had been confirmed by U.S. Immigration and Customs Enforcement (ICE) to be aliens (i.e., non-citizens and non-nationals), while 15,536 aliens were still under investigation by ICE to determine alienage and/or removability.

 Among the 42,284 confirmed aliens, 39,413 people (93%) were unlawfully present.

These numbers include a 625% unlawful rate among 38,132 known or suspected aliens in BOP custody and a 78% unlawful rate among 19,688 confirmed aliens in USMS custody.

 Approximately 16,233 aliens in USMS custody required housing in state, local, and private facilities, which cost $1,458,372.72 per day.

 Here's a breakdown of the crimes from Texas alone between 2011 and 2018. The report notes, "These data do not account for all aliens in the Texas criminal justice system, as they are limited to criminal alien arrestees who have had prior interaction with DHS resulting in the collection of their fingerprints."

 More than 663,000 criminal offenses; 1,351 homicides; 7,156 sexual assaults; 9,938 weapons charges;
79,049 assaults; 18,685 burglaries; 79,900 drug charges; 815 kidnappings; 44,882 thefts; 4,292 robberies.

 "The illegal alien crime rate in this country should be zero," Attorney General Sessions released in a statement. "Every crime committed by an illegal alien is, by definition, a crime that should have been prevented. It is outrageous that tens of thousands of Americans are dying every year because of the drugs and violence brought over our borders illegally and that taxpayers have been forced, year after year, to pay millions of dollars to incarcerate tens of thousands of illegal aliens.

 That is another reason why the Department of Justice under President Trump's leadership has instituted a zero tolerance policy for illegal entry on our Southwest border.

 Today's report is yet another reminder that we must continue this policy and help fulfill President Trump's goals of restoring lawfulness to our immigration system and ensure that immigration serves the good of this country."

 The numbers come as illegal crossings over the U.S. southern border with Mexico have exponentially skyrocketed in recent months.

 “Bad actors know well our legal loopholes which act as a magnet for illegal immigration,” Department of Homeland Secretary Kirstjen Nielsen said. “As DHS continues to carry out President Trump’s immigration priorities to keep America safe, Congress must urgently act to close dangerous loopholes that attract criminal aliens and also inhibit our ability to remove them.”

The Deferred Action for Childhood Arrivals program could come to an end if the Trump administration is successful in what appears to be a secondary protocol for how to deal with an executive order that is arguably unconstitutional.

  Executed under the obuma White House, DACA shields illegal aliens brought over as children who have met a certain criteria (i.e. no criminal record) from deportation. There is a separation of powers concern.

 It’s been on shaky legal footing for quite some time, which is why the Trump White House had a six-month enforcement delay when they announced they would be phasing out the program.

 Cue the Democratic outrage, but that six-month lull period was meant to give Congress time to get their act together and pass a DACA fix. They fumbled that.

 The Trump administration felt they couldn’t argue in defense of the law due to the constitutional issues and facing a lawsuit from various state attorneys general, they felt this was their best option—and it probably was. 

 Yet, it’s still an issue that paralyzes the Hill. The Democrats shut down the government over it, a federal judge said they have to keep DACA a functioning program, and now we have two bills from the conservative and moderate wings that are set for a vote next week. Neither is expected to pass. 

 What NBC News is reporting is that the Plan B of the Trump White House is to get a ruling from a federal judge in Texas to declare the program illegal, which could set in motion DACA’s death within weeks (via NBC News):

 The Trump administration is urging a federal court in Texas to declare DACA illegal, setting up a potential conflict that could allow the government to shut the program down within a matter of weeks.

 In a motion filed late Friday, Justice Department lawyers told a judge in Texas that the program violates federal immigration law. Assuming, as expected, that the judge grants the request from DACA opponents and orders the government to stop enforcing DACA, the ruling would conflict with orders from two other federal courts that require continued enforcement of the program.

 If faced with competing court orders, the Justice Department said it would then rush to the U.S. Supreme Court and tell the justices that the government would be in violation no matter what it did — keeping DACA going would violate the Texas order, while trying to shut it down would violate the other court orders.

In that event, the government would ask the Supreme Court to put a hold on all the lower court rulings. And if the justices agreed, the Trump administration would be free to shut DACA down immediately, because nothing would be in effect to prevent the government from taking that action.

 Federal district judge, Andrew Hanen of Brownsville, Texas, will likely rule in their favor. Three years ago he blocked another obuma immigration program intended to let parents who came here illegally remain in the U.S. if they have U.S.-citizen children.

 Texas and the other states have argued that DACA is illegal for the same reasons that doomed that program, known as DAPA [Deferred Action for Parents of Americans].

 That order was rescinded last June. There is a fine line here.

 I see where some in the party worry that the optics will cost us an entire voting bloc for a generation or more, but we have to enforce the law, our borders, and deport people who shouldn’t be here, namely criminal aliens and gang members like MS-13, which this administration is doing.

 This is one of the reasons why Trump was elected. There’s a new sheriff in town, but the political waters of immigration have to be navigated carefully.

 Democrats are making it a lot easier by defending MS-13 thugs as people who aren’t so bad, and Trump has the ability to make them defend the indefensible.

  Yet, before that popcorn-worthy feature, let’s see how this legal challenge plays out.

What NBC News is reporting is that the Plan B of the Trump White House is to get a ruling from a federal judge in Texas to declare the program illegal, which could set in motion DACA’s death within weeks (via NBC News):

The Trump administration is urging a federal court in Texas to declare DACA illegal, setting up a potential conflict that could allow the government to shut the program down within a matter of weeks.

In a motion filed late Friday, Justice Department lawyers told a judge in Texas that the program violates federal immigration law. Assuming, as expected, that the judge grants the request from DACA opponents and orders the government to stop enforcing DACA, the ruling would conflict with orders from two other federal courts that require continued enforcement of the program.

If faced with competing court orders, the Justice Department said it would then rush to the U.S. Supreme Court and tell the justices that the government would be in violation no matter what it did — keeping DACA going would violate the Texas order, while trying to shut it down would violate the other court orders.

In that event, the government would ask the Supreme Court to put a hold on all the lower court rulings. And if the justices agreed, the Trump administration would be free to shut DACA down immediately, because nothing would be in effect to prevent the government from taking that action.

The federal district judge overseeing the case, Andrew Hanen of Brownsville, Texas, will likely rule in their favor. Three years ago he blocked another Obama immigration program intended to let parents who came here illegally remain in the U.S. if they have U.S.-citizen children. Texas and the other states have argued that DACA is illegal for the same reasons that doomed that program, known as DAPA [Deferred Action for Parents of Americans].

That order was rescinded last June. There is a fine line here. I see where some in the party worry that the optics will cost us an entire voting bloc for a generation or more, but we have to enforce the law, our borders, and deport people who shouldn’t be here, namely criminal aliens and gang members like MS-13, which this administration is doing. This is one of the reasons why Trump was elected. There’s a new sheriff in town, but the political waters of immigration have to be navigated carefully. Democrats are making it a lot easier by defending MS-13 thugs as people who aren’t so bad, and Trump has the ability to make them defend the indefensible. Yet, before that popcorn-worthy feature, let’s see how this legal challenge plays out.
